1. Introduction and Agreement to Terms These Terms of Service ("Terms") govern your access to and use of the Restore mobile application ("the App"), developed by Jackson Ringger ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. App License Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non-commercial use on mobile devices that you own or control.
3. App Description and Features Restore allows you to capture text from physical books using your device's camera, save these text selections as "Highlights," associate them with book information, and utilize artificial intelligence (AI) features to generate summaries, flashcards, and potential connections between your Highlights.
4. User Content Ownership: You retain ownership of the copyright and other intellectual property rights in the content you create and store within the App, including your Highlights and associated book information ("User Content"). License Grant to Us: By using the App, you grant us a limited license solely to store your User Content locally on your device and to process it as necessary to provide the App's features. This includes transmitting specific User Content (highlight text, book title, author) to third-party AI services (specifically OpenAI) only when you initiate an AI feature, for the sole purpose of generating insights (summaries, flashcards, connections) to be displayed back to you within the App. We do not claim ownership over your User Content. Responsibility: You are solely responsible for your User Content and must ensure it does not violate any laws, infringe upon any third-party rights (including copyright), or contain any malicious or prohibited material.
5. Subscriptions and Payments Tiers: The App may offer a free tier with limitations (e.g., a maximum number of saved highlights) and a paid subscription tier ("Restore Pro") providing access to enhanced features, such as unlimited highlights. The specific features and limitations are described within the App. Payment Processing: All payments for subscriptions are processed through Apple's App Store In-App Purchase platform. Your purchase will be subject to Apple’s applicable payment policy, which may not provide for refunds. You should review Apple's terms and conditions before making any purchases. We do not collect or store your payment card details. Auto-Renewal: Paid subscriptions typically auto-renew for the same duration unless cancelled.

Cancellation & Management: You can manage and cancel your subscriptions at any time through your Apple Account settings on your device. 6. Third-Party Services The App utilizes the following third-party services to provide functionality: OpenAI: Used to generate AI-powered insights based on your User Content when you initiate such features. Your use of these features means your relevant User Content is processed by OpenAI. Their service is subject to OpenAI's own Terms of Use and Privacy Policies. RevenueCat: Used to manage subscription status and validate App Store receipts. Their service is subject to RevenueCat's Terms of Service and Privacy Policy. We are not responsible for the practices, terms, or policies of these third-party services. 7. Prohibited Conduct You agree not to use the App to: Violate any applicable laws or regulations. Infringe upon the intellectual property rights of others. Transmit any viruses, malware, or other harmful code. Attempt to reverse engineer, decompile, or disassemble the App. Interfere with the operation of the App or its servers. Engage in any activity that is fraudulent, abusive, or harmful. 8. Intellectual Property Excluding your User Content, the App and its original content, features, design, and functionality are and will remain the exclusive property of Jackson Ringger, protected by copyright, trademark, and other intellectual property laws. 9. Disclaimers "As Is": The App is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure. AI Content Disclaimer: The AI-generated features (summaries, flashcards, connections) are provided for informational purposes only. AI models can make mistakes and generate inaccurate or incomplete information. We make no warranties regarding the accuracy, reliability, completeness, or suitability of any AI-generated content. You should independently verify any information critical to you. Functionality: We do not warrant that the App will meet your requirements or that defects will be corrected. 10. Limitation of Liability To the maximum extent permitted by applicable law, in no event shall Jackson Ringger be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; (b) any conduct or content of any third party on the App; (c) any content obtained from the App; or (d) unauthorized access, use, or alteration of your transmissions or content, whether

based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. 11. Termination We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease. You can terminate these Terms by ceasing to use the App and deleting it from your device. 12. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. 13. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we may provide notice (e.g., via App Store update notes or an in-app notification). What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. 14.
